Liability Waiver and Release of Claims Event Name: Holiday Kink Soiree Event Date: December 6th, 2024 Event Location: Sugar Lounge Host: Hart Soirees This Liability Waiver and Release of Claims ("Waiver") is executed by purchasing a ticket by the ticket holder ("Participant") in favor of Hart Soirees, its employees, volunteers, agents, representatives, and any affiliated entities (collectively, "Organizer"). 1. Acknowledgment of Risk The Participant acknowledges that participation in the Open Relationship Gathering involves certain inherent risks, including but not limited to the risk of personal injury, illness (including sexually transmitted infections), property damage, and other potential hazards. The Participant voluntarily chooses to participate in the Event with full knowledge and understanding of these risks. 2. Assumption of Risk The Participant assumes full responsibility for any risks of injury, illness, death, or property damage that may arise from their participation in the Event. The Participant acknowledges that these risks may be caused by their own actions or inactions, the actions or inactions of others, the conditions of the Event venue, or the negligence of the Organizer. 3. Release and Waiver of Liability In consideration of being permitted to participate in the Event, the Participant hereby releases, waives, discharges, and covenants not to sue the Organizer, its employees, volunteers, agents, and representatives from any and all liability, claims, demands, actions, or causes of action that may arise from or relate to the Participant’s participation in the Event, whether caused by the negligence of the Organizer or otherwise. 4. Indemnification The Participant agrees to indemnify and hold harmless the Organizer, its employees, volunteers, agents, and representatives from any and all claims, demands, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or in connection with the Participant’s participation in the Event, including any injury or damage to the person or property of the Participant or others. 5. Health and Safety Compliance The Participant agrees to adhere to all health and safety guidelines provided by the Organizer, including but not limited to the use of protection during sexual activities, disclosing any known health conditions that could affect others, and respecting the personal boundaries of other participants. The Participant acknowledges that failure to comply with these guidelines may result in expulsion from the Event. 6. Medical Treatment The Participant consents to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during the Event. The Participant agrees to be responsible for all costs associated with such medical treatment. 7. Confidentiality and Privacy The Participant agrees to respect the confidentiality and privacy of all Event participants. The Participant understands that the Event may involve sensitive personal information and agrees not to disclose any such information to third parties without the express consent of those involved. 8. No Guarantee The Organizer makes no guarantees or representations regarding the safety, outcomes, or experiences of participants at the Event. The Participant acknowledges that they are responsible for their own decisions and actions during the Event. 9. Governing Law This Waiver shall be governed by and construed in accordance with the laws of the State of [State], without regard to its conflict of laws principles. 10. Acknowledgment of Understanding The Participant acknowledges that they have read this Waiver, fully understand its terms, and understand that they are giving up substantial rights, including the right to sue the Organizer. The Participant acknowledges that they are signing this Waiver freely and voluntarily, and intend by their signature to provide a complete and unconditional release of all liability to the greatest extent allowed by law.

By purchasing a ticket and/or attending the Holiday Kink Soiree ("Event"), you ("Participant") agree to comply with the following terms and conditions. These terms and conditions are a binding legal agreement between the Participant and Hart Soirees("Organizer"). Please read them carefully. 1. Admission Requirements Participants must be at least 21 years of age to attend the Event. A valid government-issued ID is required for entry. Admission is non-transferable and non-refundable, except as expressly stated in the refund policy. The Organizer reserves the right to refuse entry to any Participant at their sole discretion. 2. Code of Conduct Participants are expected to behave respectfully and responsibly at all times. Consent is mandatory for all interactions, and any violation of consent will result in immediate removal from the Event. Harassment, discrimination, or inappropriate behavior based on race, gender, sexual orientation, religion, or any other characteristic will not be tolerated. The use of drugs or excessive alcohol is strictly prohibited. Participants under the influence may be asked to leave the Event. 3. Health and Safety Safe sex practices are strongly encouraged. Protection will be provided at the Event, and it is the responsibility of each Participant to use it. Participants must disclose any known sexually transmitted infections (STIs) to potential partners before engaging in sexual activities. If a Participant feels unwell or experiences any symptoms of illness, they must refrain from attending the Event. 4. Confidentiality Participants agree to respect the privacy of others attending the Event. Sharing personal information, images, or details about other Participants without their express consent is strictly prohibited. No photography or recording devices are allowed at the Event unless explicitly permitted by all individuals involved. 5. Liability and Indemnity The Participant attends the Event at their own risk. The Organizer is not liable for any personal injury, illness, or property damage that may occur during the Event. Participants agree to indemnify and hold harmless the Organizer, its employees, agents, and representatives from any claims, damages, or expenses arising from their participation in the Event. 6. Event Modifications The Organizer reserves the right to change the date, time, location, or other aspects of the Event without prior notice. In the event of significant changes, the Organizer will make reasonable efforts to notify Participants as soon as possible. The Organizer may cancel the Event at their discretion. In the event of cancellation, Participants will be entitled to a refund of the ticket price, excluding any processing fees. 7. Refund Policy Tickets are non-refundable unless the Event is canceled by the Organizer. In the event of cancellation, refunds will be issued to the original payment method. If a Participant is removed from the Event for violating the terms and conditions, no refund will be provided. 8. Use of Personal Data The Organizer may collect and use personal data provided by Participants during the ticket purchase process for the purpose of organizing and managing the Event. This data will not be shared with third parties without the Participant’s consent. Participants have the right to request access to or deletion of their personal data at any time by contacting the Organizer. 9. Governing Law These terms and conditions shall be governed by and construed in accordance with the laws of the State of [State], without regard to its conflict of laws principles. Any disputes arising out of or in connection with these terms and conditions shall be resolved through mediation before resorting to any other form of dispute resolution. 10. Acknowledgment and Acceptance By attending the Event, Participants acknowledge that they have read, understood, and agreed to these terms and conditions. The Organizer reserves the right to amend these terms and conditions at any time. Participants will be notified of any changes, and continued participation in the Event will constitute acceptance of the revised terms.

Tickets can be transferred but not refunded.
