SunBurn 2024: Mirage

AS A TICKET HOLDER AND/OR ATTENDEE AT SUNBURN (THE EVENT), I hereby agree to all the conditions as listed herein and on Multipass Tickets and on the official SunBurn Webpage (nmsunburn.com) to gain entry to the property and the SunBurn 2024 Event. By purchasing a ticket to SunBurn, I agree to comply with all policies regarding the Event. I agree that I am willingly entering the Property and the Event at my own risk; that, in order to gain access to and to attend the Event, I will abide by the conditions, policies, guidelines and rules as posted on the website or ticketing site and set forth herein before, during, and after the Event, and subject to change at any point prior to the Event. BY PURCHASING A TICKET TO SUNBURN, I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING AND/OR VOLUNTEERING IN THE EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the Event holders, sponsors, and the Organizers of the Event, and that it will govern my actions and responsibilities at said Event. In consideration of admission to participate in the Event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) I FOREVER RELEASE AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me, THE FOLLOWING ENTITIES OR PERSONS: Socorro County, New Mexico Burners LLC, NMSPF90 LLC, Burning Man Project, their agents and representative, the SunBurn Event producers, staff, and organizers (collectively the Organizers), and the property its owners and employees (collectively the Owners);(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity or Event, whether caused by the negligence of release or otherwise.I ACKNOWLEDGE THAT PARTICIPATION IN THE EVENT AND USE OF THE PROPERTY MAY CARRY RISKS, INCLUDING POTENTIAL DEATH, SERIOUS INJURY, AND PROPERTY LOSS. I acknowledge and understand that the nature of the Event, the unique interactive art, the rapidly changing weather conditions, and venomous creatures that inhabit the area may contain natural or manmade hazards. I ACKNOWLEDGE THAT: I also understand certain risks are present at the Event, including (but not limited to): hazardous terrain, including low visibility at night; high altitude; wild and domestic animals; cold and or hot climate and weather; equipment and infrastructure constructed by other Event attendees; limited supervision; the presence (but NOT the sale) of alcohol; the availability (or lack thereof) of medical facilities and/or assistance; use of fire; and possible adult themes and/or nudity. NMSPF90 LLC.. DOES NOT MANAGE AND CANNOT GUARANTEE THE SAFETY OF ANY INFRASTRUCTURE, ART, OR ACTIVITY PERFORMED, CONSTRUCTED, OR OFFERED BY OR WITH THE ASSISTANCE OF EVENT PARTICIPANTS. I have been informed of these risks and understand all rules of participation in the event. I am responsible for reading , understanding and complying with all signage and instructions from NMSPF90 LLC., including the Survival Guide 2023, instructions provided at the gate by Gate, Greeters or DPW Departments and/or NMSPF90 LLC. and instructions from organizers; and I understand that I must , at all times, avoid leaving the marked boundaries of the Event and its the designated festival areas. I assume all responsibility for loss or damage to equipment or personal property, and understand that no reimbursement will be made by NMSPF90 LLC. in the event that equipment or personal property is lost, stolen or damaged. I understand that my ticket is a revocable license that may be revoked by NMSPF90 LLC. in the event that I fail to follow any posted instructions or instructions received from designated NMSPF90 LLC. representatives. I appoint NMSPF90 LLC. as my representative to take actions necessary to protect my intellectual property or privacy rights, recognizing that NMSPF90 LLC. has no obligation to take any action whatsoever. I agree that commercial use of recordings and images taken at the Event is prohibited without the prior written consent of NMSPF90 LLC., and that NMSPF90 LLC. may use images and recordings from the Event (which may include me) for non-commercial purposes. I AGREE NOT TO ENTER ANY RESTRICTED OR CORDONED OFF AREAS OR TRESPASS BEYOND THE EVENT BOUNDARIES. I agree that and I am 100% responsible for my camp, my personal well-being, and personal property at all times. There is no water, food, or fuel within miles of this property. I must come prepared with food, water, shelter, warm clothing, bedding, and anything else I need to survive during the Event. No pets are allowed. The Organizers and the Owners reserve the right to deny anyone access to the Event and the Property or demand they leave for any reason. Note: SunBurn is not a rave. Sunburn is an interactive community of artists, performers, musicians and participants creating both large- and small-scale art on private land. This is a private Event on private property and is not open to the general public. I agree to inform the Event staff at the entrance Gate the gender & age of any minor in my party. Any attendees under the age of 18 must have a Ticketed parent or guardian at least 21 years of age present with them at the gate when they check-in, along with documentation to prove they have the legal ability to sign all legal documents on behalf of that minor. This is a Leave No Trace Event. Pack it in and pack it out. Should I transfer a ticket in any way to a new ticket holder, that new ticket holder automatically assumes all of the terms and conditions herein. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
